A COURT date has been set after a developer faced enforcement action after a planning breach.

Crest Nicholson faced a backlash after altering the Tiptree Nine Acres development site without authorisation.

The developer will now be going to court in October after an area of raised soil heaps was created on the site without permission.

The developer said the heaps “are not a permanent fixture" and are required to complete the allotments on the site.

A the latest full council meeting, Tiptree Parish Council discussed the concerns regarding the site, which included a zebra crossing which was part of the original site application made in 2013.

The zebra crossing, allotments and bus shelter have not yet been executed as part of the plans.

A spokesman for Tiptree Parish Council said: “A site meeting was held between Colchester City Council and the developers for Nine Acres (Crest Nicholson), at which both the chairman of Tiptree Parish Council and the clerk were invited.

“The meeting was held to establish plans by the developer to remedy the breach notification, for which a court date has been set for October 4.

“This was specifically for the open space and allotments, although the zebra crossing and bus shelter were also briefly discussed (as an Essex County Council item, as they are querying the current placement).”
