WORRIED residents have been criticised for “illegally” closing a public footpath during the coronavirus pandemic, despite it being a public right of way.

A footpath running alongside Cobbins Grove, in Burnham,has been bolted shut and residents have put up a sign saying the path is closed.

Essex Highways says the sign and closure are “misleading and inappropriate”.

Advice from walking charity the Ramblers Organisation, based on Government guidelines, says gates should be secured open during the pandemic to minimise the number of people having to touch them.

One resident, who wanted to remain anonymous, said: “They have bolted shut a gate, erected by themselves, that you have to use to access the footpath, and are actively patrolling the entrance to try to prevent members of the public using it.

“They have put a homemade sign on the gate to advise that the public footpath is closed, claiming it will help with social distancing - the exact opposite of their actions as they actively try to block public access.”

An Essex Highways spokesperson said: “Several local residents have reported this illegally locked gate and misleading and inappropriate sign on the public footpath, which is and remains legally a public right of way.

“Public rights of way cannot be closed without legitimate Government, council or police authority, and no such closure has been made. Highways inspectors will take steps to ensure that the path is re-opened as quickly as possible.”

Burnham town mayor Wendy Stamp said: “The footpath closure has been reported to Essex County Council as will any others if people have no right to close them .

“I am sure Essex County Council will be looking into this matter and issue instructions accordingly.

“I ask everyone to adhere to Government advice and work within guidelines and laws enabling keeping everyone safe.”
