THE council has not defended its stance on an appeal for the development of the North Heybridge Garden Suburb.

Last Thursday Maldon District Council considered the appeal to bring the new 1,138 home development, which was denied by the council in June.

As part of the plans, a 120-bed residential care home community, a new primary school, nursery and sports centre would also be built to accompany the new community.

Following the meeting, Adrian Fluker, leader of Maldon District Council, said: “At a special meeting of council on Thursday 29 August, Members considered advice from the council’s senior solicitor and the legal opinion of counsel, in relation to the current appeal which has been lodged with the planning inspector for the refusal of the planning application - Land at Broad Street Green Road, Maypole Road and Langford Road, Heybridge.

"After a lengthy debate and careful consideration of the legal opinion and advice from the council’s senior solicitor, the council has agreed not to defend the appeal which has been lodged.

"The council will continue to consider the application which has been resubmitted by the applicant, as part of the usual planning process."
