The Essex County Council (Maldon District) (Prohibition of Waiting, Loading and Stopping) And (On-Street Parking Places) (Civil Enforcement Area) (Amendment No.5) Order 2022

NOTICE IS HEREBY GIVEN that Chelmsford City Council acting on behalf of the South Essex Parking Partnership in exercise of the delegated powers of the traffic authority Essex County Council granted under an agreement dated 31 March 2011 (and subsequently varied by Deed of Variation on 15 June 2011 and 27 July 2012) has made the above Order under Sections 1(1), 2 (1) to (3), 4(1), 4(2), 32(1), 35(1), 45, 46, 49, 53 and Parts III and IV of Schedule 9 of the Road Traffic Regulation Act 1984. Effect of the Order: All measurements are taken as accurately as possible and are taken from the extended kerb line unless stated otherwise. 1. To revoke 'No Waiting at Any Time/No Loading Monday to Saturday 8am-9.30am' restrictions on the following length of road in the District of Maldon:

White Horse Lane, Maldon
West Side: From where New Street becomes White Horse Lane, north-eastwards and northwards to a point 1 metre south of the southern boundary of No. 2 White Horse Lane. West Side: From a point 8 metres north of the southern boundary of No. 2 White Horse Lane, northwards for 15 metres. North & West Sides: From a point 27 metres west of its junction with Carmelite Way westwards and southwards for 72 metres. South & East Sides: From a point 27 metres west of its junction with Carmelite Way westwards and southwards to its junction with the southern arm of New Street.
6. This order will also formally replace restrictions on the following lengths of road in the District of Maldon. This is purely a paper exercise (no changes on the ground) to ensure the map records are updated and match the restrictions historically implemented:

East Side: From a point 1 metre southwest of the northeastern boundary of No. 11 Market Hill, south-westwards for 2 metres.
2. To revoke 'No Waiting at Any Time' restrictions on the following length of road in the District of Maldon:

Foundry Lane, Burnham-on-Crouch
Northwest Side: From a point 87 metres northeast of its junction with Fairway Drive, north-eastwards for 15 metres.
3. To introduce 'No Waiting at Any Time' restrictions on the following lengths of road in the District of Maldon:

Foundry Lane, Burnham-on-Crouch
Northwest Side: From a point 15 metres southwest of its junction with Fairway Drive, north-eastwards for 35 metres.
Northwest Side: From a point 60 metres northeast of its junction with Fairway Drive, north-eastwards for 20 metres.
Devonshire Road,
Burnham-on-Crouch
Southwest Side: From a point 15 metres northwest of its junction with Lilian Road, north-westwards for 15 metres.
B1021 South Street, Tillingham, Southminster
West Side: From a point 10 metres north of its junction with Marlborough Avenue, southwards for 25 metres.
4. To introduce 'No Waiting 8.30am-6pm' restrictions on the following lengths of road in the District of Maldon:

5. To replace 'No Waiting Monday to Saturday 8am-6pm' with 'No Waiting at Any Time' restrictions on the following lengths of road in the District of Maldon:

North Side: From the eastern property wall of No.10 New Street, north-eastwards to where New Street becomes White Horse Lane. South Side: From the eastern property wall of No.10 New Street, north-eastwards to its junction with the southern arm of New Street.
New Street (southern arm), Maldon
Both Sides: From its junction with New Street/ White Horse Lane, south-eastwards and southwards for 26 metres.

Application to the High Court: Anyone who wishes to question the validity of the Order, or any provision contained in it on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984, or on the grounds that any requirement of that Act, or any instrument made under it, has not been complied with in relation to the Order, may within six weeks from the making of the Order apply to the High Court for this purpose.
