UNEVEN paving stones where a pensioner suffered serious injuries in a fall were not dangerous, according to county officials.

Essex County Council carried out a post-accident inspection on the stretch of pavement in Osborne Street, Colchester, where Margaret Griffiths tripped over last November.

In response to her husband Brian’s claim against the authority, he was told the defect was not serious enough to warrant further action and it was rejected.

He said: “A risk assessment was carried out and as a result, the defect wasn’t considered to be dangerous.

“Essex County Council deemed the pavement to be a defect risk of six out of 16, which is not considered to create an immediate danger.

“They don’t accept the council has been neglectful in its duty to maintain the highway.

“Once again, it’s not about the money, but everyone seems to know about this particular area.

“My wife was upset that it’s basically down as being her fault when the council’s own photos show the damage.”

Grandmother Margaret, 72, suffered a broken arm, dislocated and fractured her left shoulder which led to depression and anxiety.

After suffering a stroke, she spent 12 weeks in Colchester General Hospital before moving to Foxburrow Grange nursing home where she is receiving physiotherapy to be able to walk properly again.

During her hospital stay she also suffered several complications which have kept her from going home.

Brian, 71, blames his wife’s poor health on the initial accident.

He said: “Margaret is terrified of going back to town, psychologically she’s damaged, and angry that a paving stone has brought this all on her. Her speech is coming on well which is the only good thing.

“All we can do now is take legal action but our pension isn’t enough for that. I just want someone to say they’re sorry and they got it wrong. That’s what annoys me.”
