The company running a swimming pool where a seven-year-old girl died is due in court tomorrow.

Michelle Gellard, of east London, died in the swimming pool at the Blackwater Leisure Centre in Park Drive, Maldon, in June 2008.

Leisure Connection, which manages the pool on behalf of Maldon District Council , will appear at Chelmsford Magistrates’ Court tomorrow.

The firm is accused by the Health and Safety Executive of breaching section 3 (1) of the Health and Safety at Work etc Act 1974.

The section states that it is a company’s duty to ensure the health safety of persons other than employees, for example, visitors, the general public and clients.
