A company is appealing after being refused permission to build two flats behind a bank.
Threadneedle Property Investments Ltd wanted to build the studio flats behind NatWest in Burnham High Street.
It has already been granted permission for two other one bedroom flats on the same piece of land.
But Maldon District Council refused permission for the additional studio flats, saying it would be obtrusive and overbearing on neighbouring homes.
Laying out the grounds for appeal, Indigo Planning, on behalf of Threadneedle, said there is no direct line of sight between the three nearest homes and the site and the height and scale of the flats would be below the roofline of higher buildings on the High Street.
A government-appointed planning inspector will consider the appeal.
